Congress Introduces Permanent E15 Legislation

If passed, the bill would allow year-round sale of E15 gasoline.

The Nationwide Consumer and Fuel Retailer Choice Act was reintroduced in both the House and Senate yesterday to permanently allow for the year-round sale of E15 gasoline.

The bipartisan legislation would extend the Reid Vapor Pressure (RVP) volatility waiver to enable ethanol blends up to 15% to be sold nationwide all year.

"To effectively serve their customers, convenience retailers need a stable and predictable year-round market for fuels like E15," said NACS General Counsel Doug Kantor. "We are grateful to Senators Fischer and Duckworth and Representatives Smith and Craig for their continued leadership on this issue, with legislation that will improve the environmental attributes of summer gasoline while lowering costs for families and small businesses across the country."

“Homegrown biofuels are tools we have right now to address climate change, strengthen our nation’s energy infrastructure and lower costs for Americans at the gas pump,”  said Rep. Angie Craig (D-MN). “This bill is the kind of commonsense legislation we need more of in Washington, and I’m proud to be a part of the bipartisan coalition fighting for year-round E15 in the House.”

By allowing the year-round, nationwide sale of E15, this legislation will finally end years of patchwork regulations and give both producers and consumers the certainty they deserve, said Rep. Deb Fischer (R-NE) in a press release. “Securing this permanent fix, coupled with Senator Fischer's work with the administration to ensure strong renewable volume obligations (RVOs), will enable biofuels to contribute to our nation's energy dominance.”

“Higher blends of biofuels help folks save money at the gas pump, reduce our dependence on foreign oil, cut carbon emissions and support critical markets for Illinois family farmers,” said Rep. Nikki Budzinski (D-IL). “I’m proud to represent one of our nation’s top corn-producing regions and to champion biofuels production on behalf of my constituents—including as a co-lead of the Nationwide Consumer and Fuel Retailer Choice Act. Producers and consumers need more certainty and I’m confident that this legislation can take us across the finish line to secure year-round E-15.”

NACS will continue to work to pass the legislation, or get EPA to grant a waiver allowing the summertime sale of E15 in 2025 quickly, so that the industry can prepare for fuel sales for the coming summer.

Additional co-sponsors of the bill include Reps. Dusty Johnson (R-SD), Nikki Budzinski (D-IL), Mariannette Miller-Meeks (R-IA) and Sharice Davids (D-KS).
