EPA Extends Texas Fuel Waiver

On September 13, 2017, the Environmental Protection Agency (EPA) granted a waiver extension for federal RFG requirements in Texas as well a waiver of RVP standards that are subject to the Texas low-volatility gasoline program.

Besides the extension of the gasoline waivers, EPA has also waived the requirements for Texas Low Emissions Diesel (TxLED) through Oct. 1, due to an "extreme and unusual fuel supply circumstance."

The RFG waiver allows regulated parties to produce, sell or distribute conventional winter gasoline or "BOBs" in any RFG-covered area. Gasoline that does note meet the RFG requirements on Oct. 1 cannot be put into storage tanks.

Any gasoline meeting the condition of the wavier in storage on Oct. 1 can be distributed and sold until the supply is depleted, the waiver states.
