State of Texas Files Suit – Temporary Stay Granted by U.S. Fifth Circuit – Stay Tuned!
The federal Occupational Safety & Hazard Administration (OSHA) has issued their Emergency Temporary Standard for COVID vaccine and testing applicable to all private employers with 100 or more employees.  The effective date of the “30 day clock” is November 5th, 2021 and the date for compliance is December 4th, 2021 with final implementation on January 6th, 2022.

Numerous states have filed court challenges and the Fifth Circuit of Appeals has granted a temporary stay on the rule.

This alert has the links to OSHA produced documents: EMA has also prepared a reg alert that is a benefit for our members to review.
TFFA will continue to monitor the legal challenges and update you as needed.  TFFA has also prepared a more “industry specific” compilation of the Q & A document.
