Supreme Court Denies Growth's Appeal of Lower Court Order Striking E15 Rule

The U.S. Supreme Court on Monday said it will not consider ethanol industry
group Growth Energy's appeal of a July ruling by the U.S. Court of Appeals for
the District of Columbia Circuit that overturned EPA's June 2019 EPA that
allowed year-round sales of E15.

The high court's decision comes after comes after EPA in December asked it to
deny the request, saying Growth failed to "establish a sound basis" for seeking
the review.

In addition, the government said that, even if the high court were to reverse
the lower court's ruling, the decision would not lead to widespread sales of
the higher-octane blend given current market barriers.

In a statement on Monday, Growth Energy CEO Emily Skor said the group was
"certainly disappointed" with the decision.

"Growth Energy will continue to explore all potential avenues to make
unfettered access to E15 a reality," Skor said.
